  2. These Terms and Conditions set out the rules governing individual Users’ free use of oarbitrazu.pl, including downloading the Mini Handbook. They also specify the type and scope of the Services provided by the Firm, the conditions under which those Services are provided, the conditions for entering into agreements for the provision of Services, and the complaints procedure.
  3. These Terms and Conditions also constitute the terms for the provision of electronic services referred to in Article 8 of the Act of 18 July 2020 on the Provision of Electronic Services.
  4. In connection with the administration of oarbitrazu.pl, the Firm may process Users’ personal data. The Firm processes Users’ personal data in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
  5. The Website uses cookies. The rules governing the Controller’s use of cookies are set out in the Privacy Policy available at www.jklaw.pl.

Definitions

  1. Firm or JKLAW means Kancelaria Jabłoński Koźmiński i Wspólnicy Adwokaci i Radcowie Prawni sp.k., with its registered office at ul. Stanisława Moniuszki 1A, 11th floor, 00-014 Warsaw, entered in the National Court Register under KRS number 0001267145. Its registration records are held by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register. REGON: 38753671700000; NIP: 7011003997.
  2. Terms and Conditions means these Terms and Conditions.
  3. Website Owner means the Firm.
  4. Website means the website available at oarbitrazu.pl and managed by JKLAW. Use of the Website includes viewing its content.
  5. Privacy Policy means the document or Website page setting out the rules for processing personal data, available at www.jklaw.pl.
  6. Services means the services provided electronically by JKLAW to Users, namely access to the Website and the Mini Handbook service.
  7. User means a natural person who uses the Website or one or more of the services or features described in these Terms and Conditions, or whose personal data is processed by JKLAW.
  8. Newsletter means an electronic service provided by the Website Owner to a User, consisting of information prepared and sent by the Website Owner to the email address supplied by the User. It may contain informational, promotional and/or advertising content concerning the Website Owner and/or other persons and/or goods and/or services offered by the service provider and/or other persons, including, in particular, commercial communications.
  9. Controller means the Firm, acting as the controller of Users’ personal data. For matters concerning your personal data, you may contact the Controller at the postal address stated above or by email at office@jklaw.pl.
  10. Consumer means a natural person entering into a legal transaction with a trader that is not directly connected with that person’s business or professional activity.
  11. Trader means a natural person, legal person or organisational unit without legal personality to which specific legislation grants legal capacity, carrying on business or professional activity in its own name.
  12. Trader with Consumer Rights means a natural person using the Website where such use is not of a professional nature for that person, as determined in particular by the subject matter of their business activity disclosed under the provisions governing the Central Registration and Information on Business.

General Terms of Use of the Website

  1. Use of the Website is voluntary and free of charge for all Users.
  2. A User may stop using the Website at any time.
  3. An agreement for the provision of access to the Website is entered into on the terms set out in these Terms and Conditions, for an indefinite period, when the User successfully opens the Website’s URL in a browser on their device or follows a link leading to the Website, that is, when the User enters the Website. In this case, the agreement for access to the Website terminates when the User leaves the Website.
  4. A User may terminate any agreement for the provision of electronic Services at any time, with immediate effect and without giving a reason.
  5. To use the Services provided by the Website Owner, a User must read and accept these Terms and Conditions without amendment or reservation.
  6. The Website is intended to provide information, present the Firm’s arbitration practice and make its promotional materials available.
  7. Users understand that content posted by the Firm on the Website is general and informational in nature, is not tailored to any individual and must not be regarded as the provision of advice of any kind.
  8. Users must not submit or transmit unlawful content when using the Website. Users must use the Website in accordance with the principles of social conduct and intellectual property law.

Technical Requirements

  1. To use the Website, a User must meet the following minimum technical requirements:
    a) have a computer or mobile device equipped with an operating system;
    b) have Internet access on that computer or mobile device;
    c) have a properly installed and configured web browser on that computer or mobile device (Mozilla Firefox, Google Chrome, Internet Explorer or Safari); and
    d) have an active email account.
  2. The Firm does not guarantee that every combination of the technical conditions listed above will always enable use of the Website and accepts no liability in this respect.

Newsletter

  1. The Firm provides a free electronic legal Newsletter service consisting of marketing information, expert content and information about forthcoming events sent to Users.
  2. An agreement for the provision of the Newsletter service is entered into by completing the Newsletter subscription form.
  3. To subscribe to the Newsletter, a User must provide an email address and confirm the subscription by clicking the “Subscribe” button. Users must provide accurate information in the form.
  4. A User may unsubscribe from the Newsletter at any time by:
    a) sending an unsubscribe request by email to office@jklaw.pl; or
    b) sending an unsubscribe request by post to Kancelaria Jabłoński Koźmiński i Wspólnicy Adwokaci i Radcowie Prawni sp.k., ul. Stanisława Moniuszki 1A, 11th floor, 00-014 Warsaw.

Complaints

  1. A User may submit a complaint concerning the use of the Services described in these Terms and Conditions by email to office@jklaw.pl or by post to Kancelaria Jabłoński Koźmiński i Wspólnicy Adwokaci i Radcowie Prawni sp.k., ul. Stanisława Moniuszki 1A, 11th floor, 00-014 Warsaw.
  2. Complaints concerning the provision of electronic services will be considered within no more than 30 calendar days of receipt.
  3. The Firm will send its response to the email address provided by the User in the complaint or, if the complaint was submitted by post, to the postal address provided by the User.
  4. A User has the right to submit a complaint with a view to resolving a potential dispute with JKLAW through the EU online dispute resolution platform (ODR platform) at: https://ec.europa.eu/consumers/odr.

Data Processing

Information about the rules governing the processing of personal data, including Users’ rights in connection with such processing, is set out in the Privacy Policy available at www.jklaw.pl.

Amendments to the Terms and Conditions

  1. The Firm may amend these Terms and Conditions unilaterally, insofar as they have not been individually agreed with a User, for justified reasons. Such reasons include, in particular:
    a) a change in generally applicable law in the Republic of Poland, insofar as that change affects the content of these Terms and Conditions or requires the Website Owner to amend them in a particular way;
    b) a decision, similar act or guidance issued by a public administrative authority, insofar as it affects the content of these Terms and Conditions or requires the Firm to amend them in a particular way;
    c) the introduction of new Website features by the Website Owner or a change to the scope of existing features;
    d) the introduction of new IT systems by the Website Owner or changes to existing IT systems; or
    e) the emergence of judicial or administrative case law indicating that contractual provisions similar to those used by the Website Owner may conflict with generally applicable law, including, in particular, consumer protection law, from the perspective of the average consumer or a trader to whom the provisions of the Consumer Rights Act apply. In this case, an amendment to these Terms and Conditions is permitted only if it is to that person’s benefit.
  2. An amendment to these Terms and Conditions does not affect agreements entered into before the amendment takes effect. Agreements entered into before that date remain subject to the version of the Terms and Conditions in force when the User expressed their intention to enter into the agreement.
  3. The Website Owner will inform Users of an amendment by publishing a notice on the Website stating the proposed changes, the date on which they will take effect and the consolidated wording of the amended Terms and Conditions.
  4. Amendments take effect on the date specified in the notice. They are binding on a User provided that the User has been properly notified and has not terminated the agreement within 14 days of receiving notice of the amendment.

Final Provisions

  1. These Terms and Conditions apply from the date on which they are published on sportlaw.eu.
  2. These Terms and Conditions are made available free of charge through the Website.
  3. Use of the Website is governed by Polish law and is subject to the jurisdiction of the Polish courts. Matters not covered by these Terms and Conditions are governed by the relevant provisions of generally applicable law in the Republic of Poland.
  4. Nothing in these Terms and Conditions limits the statutory rights of a Consumer or a Trader with Consumer Rights under the laws applicable in the Republic of Poland.
  5. Any disputes concerning the Website or the Services provided by JKLAW are subject to the exclusive jurisdiction of the court having jurisdiction over the Website Owner’s registered office.
